San Jose Personal Injury Arbitration

Arbitration, mediation and other alternative dispute resolution (ADR) options are becoming increasingly popular. Through these ADR methods, both parties are able to resolve their disputes in a less-costly and more time-efficient manner. At The Liccardo Law Firm, LLP, we offer experienced mediation and arbitration support to plaintiffs involved in personal injury disputes.

What Is Arbitration?

Arbitration is a binding form of dispute resolution where both parties present their case and an assigned arbitrator makes a final determination. If you are entering into arbitration, it is important to consult with an experienced attorney who will protect your rights and long-term interests. We will collect relevant evidence, articulate your interests, and work to maximize your recovery during the arbitration and settlement process.

Benefits to Arbitration

Many arbitrations are mandated by a legal contract. You can also enter arbitration based on an agreement between the parties after an accident or injury. Arbitration is a cheaper and easier way to resolve any dispute because you do not have the time and expense of trial. Evidence is presented in a more economic manner (piecemeal or through reports). Arbitration is also quicker: A case can be resolved in three to four days instead of weeks or months for a personal injury trial. Most arbitrations are for smaller personal injury cases (less than $100,000), but not all.

What Is Mediation?

Mediation is a private, informal and voluntary submission of a dispute. In it, the parties are assisted by a neutral third party as they work toward a voluntary recovery. Mediation allows both parties and their attorneys to fully explain to the mediator their position, needs, abilities and problems. Attorney Sal Liccardo can act as an attorney representing a party in mediation, or as a neutral third party mediator. Mediation is non-binding.
